n Florida, home invasions are severely punished for public safety reasons. This theft crime is considered a first-degree felony carrying a possible sentence of up to 30 years in prison, 30 years of probation, and up to $10,000 in fines. The crime also carries with it a minimum mandatory 34 and ½ months of prison time.

If a weapon or firearm was used during the commission of a home invasion, the penalties increase to a minimum prison sentence of 66 months in prison. Furthermore, the person may be subject to Florida’s 10/20/Life enhancement law.

Under this law, a minimum sentence may be imposed of 10, 20, or 25 years to life in prison as follows:

  • A minimum 10-year prison term if in possession of a firearm
  • A minimum 20-year prison term if the firearm was discharged
  • A minimum 25-year prison term if someone was injured or killed by a firearm

Other types of robbery such as sudden snatching of another’s property, carjacking, or armed robbery also involve force or threat and are charged as felonies. Robbery without using a deadly weapon is generally charged as a second-degree felony punishable by up to 15 years in prison. Robbery while using a deadly weapon is charged as a first-degree felony punishable by up to life in prison.
