Carjacking occurs when a person intentionally and unlawfully takes another person’s motor vehicle through the use of force, violence, or threat.

As a first-degree felony, this crime carries a possible sentence of up to 30 years in prison, 30 years of probation, and up to $10,000 in fines. It also carries a minimum mandatory 21 months of prison time. If a weapon or firearm was used during the carjacking, the penalties increase to a minimum of 48 months in prison.

Under Florida law, a person who is convicted of actually possessing a firearm during a carjacking is subject to being sentenced under the 10/20/Life statute.

This could result in minimum prison terms of:

  • 10 years if in possession of a firearm
  • 20 years if the firearm was discharged
  • 25 years if someone is injured or killed by the firearm
